Lowe & Co Photobooths

Throughout this agreement:
  • “We”, “Us”, “Our” refers to Lowe & Co Photobooths
  • “Client”, “You”, “Your” refers to the person or organisation booking our services
By paying a booking fee and confirming your event with Lowe & Co Photobooths, you agree to the following terms and conditions. This agreement forms the full understanding between both parties and overrides any previous verbal or written discussions.
1. Booking & Payments
1.1 Booking Fee
A non-refundable booking fee is required to secure your event date. Your booking is not confirmed until the booking fee has been received.
1.2 Final Payment
The remaining balance must be paid no later than 12 days before the event date unless otherwise agreed in writing.
1.3 Failure to Pay
If full payment is not received by the due date, Lowe & Co Photobooths reserves the right to cancel the booking or withhold services until payment has been made.
1.4 Payment Plans
Payment plans may be offered at our discretion and must be adhered to as agreed. Missed payments may result in cancellation of the booking.
2. Cancellations & Changes
2.1 Client Cancellations
All booking fees are non-refundable in the event of cancellation by the client.
2.2 Date Changes
Requests to change your booking date must be made in writing at least 14 days prior to the event. Date changes are subject to availability and are not guaranteed.
2.3 Provider Cancellation
In the unlikely event Lowe & Co Photobooths cannot fulfil the booking due to circumstances beyond our control, we will refund all monies paid. Our liability is limited to the amount paid by the client.
2.4 Event Delays or Early Finish
If the event starts late, ends early, or the booth is unable to operate due to venue restrictions or guest behaviour, refunds or time extensions will not be provided.
2.5 Additional Hire Time
Additional booth hire time may be requested during the event, subject to staff availability. Extra time will incur an additional fee agreed upon at the event.
3. Venue Requirements
3.1 Space & Power
The client must provide:
  • A safe and level space of approximately 3m x 3m
  • Access to a standard 240V power outlet within 5 metres of setup
  • Safe access for loading and unloading equipment
3.2 Outdoor Events
Outdoor setups must be discussed and approved prior to the event. The booth must be placed under suitable cover and protected from weather, direct sunlight, wind, moisture, and uneven surfaces.
If weather conditions become unsafe, Lowe & Co Photobooths reserves the right to pause or end services immediately without refund.
3.3 Access Restrictions
Any venue restrictions including stairs, limited parking, difficult access, or loading requirements must be disclosed before booking. Additional fees may apply.
4. Equipment & Damage
4.1 Responsibility for Equipment
The client accepts responsibility for any loss, theft, or damage to our equipment caused by guests, venue staff, or any persons attending the event outside of normal wear and tear.
4.2 Unsafe Behaviour
We reserve the right to refuse service to anyone who is intoxicated, aggressive, unsafe, or behaving in a way that may damage equipment or impact staff safety.
4.3 Food & Drinks
Food and beverages are not permitted on or near the booth equipment or prop area.
5. Image Use & Privacy
5.1 Guest Awareness
By using the photo booth, guests acknowledge and consent to photographs being taken and stored digitally.
5.2 Promotional Use
Lowe & Co Photobooths may use images from your event for marketing, advertising, website content, and social media unless the client requests otherwise in writing before the event.
5.3 Privacy
We respect your privacy and handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
Personal information collected during the booking process is used solely for communication, event management, invoicing, and service delivery.
We do not sell or share your information with third parties unless required by law.
5.4 Online Galleries
Digital galleries may be delivered via online gallery platforms. While we take reasonable steps to protect your images, we are not responsible for unauthorised downloads, screenshots, or sharing by third parties.
6. Service Limitations
6.1 Technical Issues
While every effort is made to provide uninterrupted service, Lowe & Co Photobooths is not responsible for delays or interruptions caused by technical issues, power failures, internet outages, venue restrictions, or circumstances outside our control.
6.2 Printer Issues
If on-site printing becomes unavailable due to technical issues, digital copies of images will still be provided after the event. This does not qualify for a refund.
6.3 Liability
To the maximum extent permitted by Australian Consumer Law, Lowe & Co Photobooths will not be liable for indirect loss, consequential loss, or damages arising from the use or inability to use our services.
Nothing in this agreement excludes rights that cannot be excluded under Australian Consumer Law.
7. Travel & Additional Fees
Travel fees may apply for events outside our standard service area. Additional surcharges may also apply for:
  • Melbourne CBD locations
  • Public holidays
  • Difficult access venues
  • Extended hours
  • Last-minute bookings
Any additional fees will be discussed prior to confirmation.
8. Acceptance of Terms
By paying your booking fee, you confirm that you have read, understood, and agreed to these Terms & Conditions and Privacy Policy.
